On October 27th, 2025 the Back to School Act (Bill 2) forced a contract on public teachers via the notwithstanding clause of the Canadian Charter of Rights and Freedoms. It stipulates that teachers have to keep providing voluntary, unpaid services. Under Bill 2 teachers who withdraw voluntary services may face financial penalties of up to $500 per day.

What was a voluntary service in 2002?

This was understood to be duties performed by teachers outside of their contractual 1200 hours. This commonly included:

  • Organizing or conducting field trips outside of the normal school day
  • Participating in extracurricular activities (e.g., sports, drama, music)
  • Supervising sporting, social or other events except during the normal school day
  • Attending employer-called meetings except during the normal school day
  • Serving on or assisting employer committees
  • Participating in employer-directed inservice or professional development activities except during the normal school day
  • Accepting any communication from the employer except as it relates directly to student health and safety
  • Distributing reports and newsletters from the employer except where they concern student health and safety
  • Participating in “Meet the Teacher” events except during the normal school day
  • Organizing or participating in graduation ceremonies
  • Providing coverage for absent teachers except in an emergency
  • Attending school based meetings except during the normal school day
  • Participating in fundraising activities
  • Performing services during the daily 30-minute period designated as lunch period
  • Taking inventory
  • Ordering textbooks or supplies
  • Collecting money from students
  • Packing up classrooms to facilitate summer cleaning, painting, or classroom moves
  • Performing clerical or secretarial functions (e.g., answering phones, e-mail, keyboarding, photocopying, collating, stapling)
  • Marking achievement tests or diploma exams
  • Preparing items for diploma examinations or achievement tests
  • Assisting with testing for national or international assessment (e.g., PISA)
  • Field testing for the Minister of Learning, including examination questions and resource materials
  • Piloting new curriculum
  • Applying for, accepting, or extending any secondment, consultative or contract position with Alberta Learning
  • Serving on, consulting with, or otherwise assisting Alberta Learning committees
  • Completing or submitting any form or report to Alberta Learning
  • Distributing any Alberta Learning form, report or information to students except as directly related to instruction or safety
  • Distributing government MLA or other government promotional material
  • Participating in publicity opportunities for government MLAs
  • Viewing of all Alberta Learning officials from Association committees, specialist councils, etc.
